Priceline profit tops estimates, shares jump

(Reuters) - Priceline.com, the online travel agency known for its name-your-own-price auction, on Tuesday topped analysts' estimates for quarterly profit, citing improved hotel and car-rental reservations, and its shares rose more than 3 percent in extended trading.

Gross bookings, or the dollar value of all travel services purchased, rose 32.9 percent to $6.6 billion in the fourth quarter. Priceline said it expected those bookings to rise 30 percent to 37 percent in the current first quarter from a year earlier.

Priceline, which owes much of its success to international bookings on its Booking.com European travel site, forecast profit excluding items of $4.90 to $5.30 a share for the first quarter on a revenue increase of 17 percent to 24 percent. Analysts, on average, have forecast profit of $5.14 per share for the current quarter.

In the fourth quarter, hotel room-night reservations and booked rental-car days rose about 38 percent and 37 percent, respectively, compared with a 1.7 percent rise in airline tickets booked. Priceline said newer markets such as Asia-Pacific were contributing more to growth.

The quarterly results showed "very strong execution across international markets and in the domestic U.S. market," said Morningstar analyst Dan Su. "The foreign currency headwind that the company experienced in the past several quarters was not really a major negative impact."

The company, which competes with Expedia Inc and Orbitz Worldwide, said fourth-quarter net income was $288.7 million, or $5.63 per share, compared with $225.7 million, or $4.41 per share, a year earlier.

On a non-GAAP basis, profit was $6.77 per share. Analysts, on average, had expected $6.54 per share, according to Thomson Reuters I/B/E/S.

Quarterly revenue rose 20 percent to $1.19 billion.

Shares of Priceline.com rose 3 percent from their Nasdaq close of $678.49 after the company announced its financial results.

Researchers discover protein that may control the spread of cancer

Researchers at the University of Hawai'i Cancer Center have uncovered a novel mechanism that may lead to more selective ways to stop cancer cells from spreading. Associate Professor Joe W. Ramos PhD, a cancer biologist at the UH Cancer Center and his team have identified the role of the protein RSK2 in cancer cell migration, part of the process of cancer metastasis.

Cancer becomes metastatic when cells break away from the primary tumor and spread to other parts of the body. Metastatic cancer is much more difficult to treat and patients with metastatic cancer have a generally worse prognosis. "The cancers that kill are those that spread to other parts of the body or disseminate within the organ," said Ramos. "If we could keep cancer cells confined to the primary tumor mass, we could remove it with less risk of metastasis and later recurrence."

The Ramos team reports that RSK2 significantly increases cell migration in part by reducing integrin activation. Integrins play an important role in cell adhesion to their surrounding tissue and the migration of tumor cells to new locations in the body. RSK is active in both breast and prostate tumors, and promotes proliferation in these cells. It can also promote cell invasion and metastasis in head and neck cancers in addition to lung cancer and neuroblastoma.

"We focused on understanding the process of cell adhesion," said Ramos. "Integrins help the cell move by grabbing onto proteins and cells in their surroundings, pulling, then releasing and grabbing on again. Blocking a cancer cell's ability to adhere and move can control further dissemination of some metastasis. There are drugs that kill cancer cells and there are drugs that stop the division of cancer cells, but there are far fewer drugs that specifically stop the movement of cancer cells. Our work suggests that drugs that interfere with RSKs may help control or prevent metastasis."

Daytona's preliminary TV rating up from last year

DAYTONA BEACH, Fla. (AP) ? With Danica Patrick starting from the pole, the Daytona 500's preliminary television ratings were much higher than last year's.

Sunday afternoon's race earned a 10.0 overnight rating and 22 share on Fox, the network said Monday. That's up 30 percent from 2012, when rain pushed the event to a Monday night. It was the highest overnight rating since 2006.

Jimmie Johnson won the race while Patrick was eighth, the best finish by a woman at the Daytona 500.

The race had plenty of buildup: Patrick making history as the first woman to start a Sprint Cup race from the pole, the revamped cars, no more tandem drafting, and a frightening crash the day before in the second-tier Nationwide Series.

"I noticed something last night coming out of the track for dinner, just seemed to be a different vibe inside the infield," said Dale Earnhardt Jr., who finished second Sunday. "People seemed more excited about what was getting ready to happen. Even today, there seemed to be a whole lot more people here. Seemed to be a lot more excitement about the race.

"That really was the biggest motivator for me. I think we're headed in the right direction. ... For some reason, it just felt like we're on the right track as a sport. That's got me really excited."

Ratings represent the percentage of all homes with televisions tuned to a program. Shares represent the percentage of all homes with TVs in use at the time. Overnight ratings measure the country's largest markets.

(AP) ? BP put profits ahead of safety and bears most of the blame for the disastrous 2010 spill in the Gulf of Mexico, a U.S. Justice Department attorney charged Monday at the opening of a trial that could result in the oil company and its partners being forced to pay tens of billions of dollars more in damages.

The London-based oil giant acknowledged it made "errors in judgment" before the deadly blowout, but it also cast blame on the owner of the drilling rig and the contractor involved in cementing the well. It denied it was grossly negligent, as the government contended.

The high-stakes civil case went to trial after attempts to reach an 11th-hour settlement failed.

Eleven workers were killed when the Deepwater Horizon rig leased by the BP exploded on April 20, 2010. An estimated 172 millions of gallons of crude gushed into the Gulf over the three months that followed in the worst offshore oil spill in U.S. history.

Justice Department attorney Mike Underhill said the catastrophe resulted from BP's "culture of corporate recklessness."

"The evidence will show that BP put profits before people, profits before safety and profits before the environment," Underhill said in opening statements. He added: "Despite BP's attempts to shift the blame to other parties, by far the primary fault for this disaster belongs to BP."

BP attorney Mike Brock acknowledged that the oil company made mistakes. But he accused rig owner Transocean Ltd. of failing to properly maintain the rig's blowout preventer, which had a dead battery, and he claimed cement contractor Halliburton used a "bad slurry" that failed to prevent oil and gas from traveling up the well.

BP has already pleaded guilty to manslaughter and other criminal charges and has racked up more than $24 billion in spill-related expenses, including cleanup costs, compensation for businesses and individuals, and $4 billion in criminal penalties.

But the federal government, Gulf Coast states and individuals and businesses hope to convince a federal judge that the company and its partners in the ill-fated drilling project are liable for much more in civil damages under the Clean Water Act and other environmental regulations.

One of the biggest questions facing U.S. District Judge Carl Barbier, who is hearing the case without a jury, is whether BP acted with gross negligence.

Under the Clean Water Act, a polluter can be forced to pay a minimum of $1,100 per barrel of spilled oil; the fines nearly quadruple to about $4,300 a barrel for companies found grossly negligent, meaning BP could be on the hook for nearly $18 billion.

The judge plans to hold the trial in at least two phases. The first phase, which could last three months, is designed to determine what caused the blowout and assign percentages of blame to the companies involved. The second phase will determine how much crude spilled into the Gulf.

During opening arguments, BP and its partners pointed the finger at each other in a tangle of accusations and counter-accusations. But BP got the worst of it, from its partners and the plaintiffs in the case.

Jim Roy, who represents individuals and businesses hurt by the spill, said BP executives applied "huge financial pressure" to "cut costs and rush the job." The project was more than $50 million over budget and behind schedule at the time of the blowout, Roy said.

"BP repeatedly chose speed over safety," Roy said, quoting from a report by an expert who may testify.

Roy said the spill also resulted from Transocean's "woeful" safety culture and failure to properly train its crew. And Roy said Halliburton provided BP with a product that was "poorly designed, not properly tested and was unstable."

Brad Brian, a lawyer for Transocean, said the company had an experienced, well-trained crew on the rig. He said the Transocean workers' worst mistake may have been placing too much trust in the BP supervisors on the rig.

"And they paid for that trust with their lives," Brian said. "They died not because they weren't trained properly. They died because critical information was withheld from them."

A lawyer for Halliburton defended the company's work and tried to pin the blame on BP and Transocean.

"If BP had shut in the well, we would not be here today," Halliburton's Donald Godwin said.

Underhill, the Justice Department attorney, heaped blame on BP for cost-cutting decisions made in the months and weeks leading up the disaster. He said two BP rig supervisors, Robert Kaluza and Donald Vidrine, disregarded abnormally high pressure readings that should have been glaring indications of trouble.

Kaluza and Vidrine have been indicted on federal manslaughter charges.

Brock, the BP lawyer, said Transocean employees on the rig also played roles in misinterpreting the "negative pressure test."

"It was a mistake made by several men from two different companies," Brock said. "They were trying to get it right. They were trying to do the right thing."

Hundreds of attorneys have worked on the case, generating roughly 90 million pages of documents, logging nearly 9,000 docket entries and taking more than 300 depositions from witnesses who could testify at trial.

"In terms of sheer dollar amounts and public attention, this is one of the most complex and massive disputes ever faced by the courts," said Fordham University law professor Howard Erichson, an expert in complex litigation.

The spill fouled marshes, killed wildlife and closed fishing grounds. Scientists warn that the disaster's full effect may not be known for years. But they have reported dying coral reefs and fish afflicted with lesions and illnesses that might be oil-related.

Barnes & Noble chairman to bid for company's retail assets

(Reuters) - Barnes & Noble Inc Chairman Leonard Riggio has told the board he plans to buy the retail assets of the company including Barnes & Noble Booksellers Inc and barnesandnoble.com, but excluding the Nook Media business, sending the company's shares up as much as 26 percent before the bell on Monday.

Barnes & Noble shares closed at $13.51 on the New York Stock Exchange on Friday, valuing the company at about $809 million.

Barnes & Noble's retail business has struggled in recent years as book buyers switched to digital formats, underscored by a 10.9 percent fall in sales at its bookstores and websites in the critical year-end holiday period.

"Riggio loves the (retail) business too much to let it go," Morningstar analyst Peter Wahlstrom said, adding that the business was attractive because it was slow-growing and did not need capital to keep going.

The company said in January last year that it might spin off its digital and e-reader business and in October it created a separate unit for its Nook and college bookstore chains called Nook Media, which Riggio said he would not buy.

The combined college book and Nook business, which includes the e-reader, digital content and accessories, contributed about 50 percent of total sales of $1.88 billion in the second quarter ended October 27.

Barnes & Noble launched the Nook in 2009 to compete with Amazon.com Inc's market-leading Kindle, and early growth attracted a big investment from Microsoft Corp last year.

The company has poured hundreds of millions of dollars into the unit, but a disappointing holiday season has raised questions about its value.

The purchase price for the retail assets is expected to comprise mainly cash and include the assumption of certain debt, Riggio, who owns nearly 30 percent of Barnes & Noble, said in a regulatory filing on Monday. (http://link.reuters.com/byc36t))

Riggio, who pioneered the book superstore format in the 1980s and 1990s, said he would provide the equity financing and arrange any debt financing for the deal.

Barnes & Noble said it has set up a committee of three independent directors to evaluate Reggio's proposal.

Evercore Partners will serve as financial adviser to the company and Paul, Weiss, Rifkind, Wharton & Garrison LLP will be legal advisers, the company said.

The Wall Street Journal reported the proposed deal on Sunday.

Barnes & Noble is scheduled to report third-quarter results on Thursday.

New film tells story of unsung civil rights leader

WASHINGTON (AP) ? Just before the March on Washington in 1963, President John F. Kennedy summoned six top civil rights leaders to the White House to talk about his fears that civil rights legislation he was moving through Congress might be undermined if the march turned violent.

Whitney Young Jr. cut through the president's uncertainty with three questions: "President Kennedy, which side are you on? Are you on the side of George Wallace of Alabama? Or are you on the side of justice?"

One of those leaders, John Lewis, later a longtime congressman from Georgia, tells the story of Young's boldness in "The Powerbroker: Whitney Young's Fight for Civil Rights," a documentary airing during Black History Month on the PBS series "Independent Lens" and shown in some community theaters.

In the civil rights struggle, Young was overshadowed by his larger-than-life peer, Martin Luther King Jr. But Young's penetration of white-dominated corporate boardrooms and the Oval Office over three administrations was critical to the movement. Working with leaders within the system, including three presidents, made him a target of criticism by those who wanted a more aggressive path to racial equality.

An appreciation for what Young brought to the movement came after his death in Nigeria in 1971 at age 49. But it was not sustained, said Dennis Dickerson, author of "Militant Mediator: Whitney M. Young Jr."

"He should not be diminished," said Dickerson, a Vanderbilt University history professor who also appears in the film.

A number of schools and facilities have been named for Young. First lady Michelle Obama graduated from a Chicago high school named for him. But his role in economic issues surrounding civil rights has not gotten just due, said Marc Morial, president and CEO of the National Urban League, an organization Young led as executive director from 1961 to 1971. During his tenure the organization greatly expanded.

Young influenced a number of anti-poverty programs such as Job Corps, housing counseling and Head Start, Morial said.

"He was one of the earliest voices who said to corporate America ... that business leaders and the business community had a stake in the development and rebuilding of urban America, but also in the success of civil rights," Morial said.

Born July 31, 1921, in Lincoln Ridge, Ky., Young learned to negotiate with whites from his father, an educated man who ran the all-black Lincoln Institute boarding school, said Bonnie Boswell, the filmmaker and Young's niece.

There, Young's father surreptitiously educated black students to become doctors, lawyers and teachers to escape segregation and poverty while tricking white financial backers of the school into believing he was training the black students to be nannies, maids, janitors and mechanics.

The school campus had been something of a shelter for Young from the everyday cruelty of segregation, but he encountered it head-on when he served in a black Army battalion led by white officers in World War II.

After that experience, Young dedicated himself to race relations. Later he borrowed on the postwar rebuilding of Western Europe to push with President Lyndon B. Johnson his proposal for a domestic Marshall Plan providing $145 billion to improve education, employment and welfare for black communities. Johnson folded some of his ideas into his Great Society programs.

Young overcame the broken relationship between blacks and President Richard M. Nixon to persuade him to heavily support social programs that assisted the poor. Nixon lauded Young's work when he spoke at his funeral.

Young's desire "was to help America live up to her ideals," Boswell said, quoting her uncle.

"He would say, 'I could become more popular if I got off the train in Harlem and shouted bad things about white people, but can I be more effective if I go downtown and help get jobs from white people to give to minorities,'" Boswell said in an interview in Washington with The Associated Press.

Young was able to tell people like industrialist Henry Ford II that they needed to step up and do something about the living and working conditions of blacks in ways that captured their respect, said Nancy Weiss Malkiel, author of the 1989 book "Whitney M. Young Jr. and the Struggle for Civil Rights."

Young was not as visible on the front lines of civil rights protests, but he could say with humor and partly in earnest to members of the white establishment that if they didn't deal with him, they would have to deal with Malcolm X and Stokely Carmichael, who espoused more radical agendas than King, Malkiel said.

Boswell's film airs as the first black president, Barack Obama, begins his second term in office. Obama, whose mother was white and father was black, has endured a racist backlash in his presidency and criticism from within the black community over whether he is doing enough for black Americans.

Dickerson said Young's ideas are a template that Obama has deployed in his political rise. "That is inter-racialism and an emphasis on corporate relations," he said. "That was Whitney Young's mantra and that's the president's mantra."

More states consider ban on credit card surcharges

Charge a fee to use your credit card? It?s legal for merchants to do that, unless barred by state law. Ten states already ban such surcharges ? California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma and Texas ? and more may join the list.

The legislatures in 13 other states are currently considering bills that would prevent these so-called ?check out? fees. Lawmakers in Hawaii, Illinois, Kentucky, Maryland, Missouri, New Jersey, Pennsylvania, Rhode Island, South Carolina, Utah, Vermont, Washington and Tennessee are responding to a rule change that took place late last month. A similar bill will soon be introduced in West Virginia.

Visa and MasterCard agreed to let merchants add a surcharge to credit card transactions as part of the settlement agreement in an antitrust lawsuit brought by retailers. Until Jan. 27, both Visa and MasterCard had prohibited merchants from charging the customer for the cost of processing that credit card transaction.

The settlement does not affect Visa or MasterCard debit cards. American Express still prohibits a surcharge on any of its cards.

New Jersey Assemblyman Vincent Prieto (D-Secaucus) said he introduced a bill to ban surcharging because it would hit consumers in the pocketbook.

?The amount of the surcharge may seem miniscule on paper, but in the family budget 1.5 to 3 percent could add up to a shorter grocery list or less to spend on gas,? he said in a statement.

In Utah, Sen. Curtis Bramble (R-Provo) is sponsoring a bill that would prohibit surcharges on any type of ?financial transaction card? which would include debit cards.

Major retailers are not expected to tack on a credit card surcharge, at least not any time in the immediate future. Wal-Mart, Target, Sears and Home Depot told NBC News they have no plans to add a credit card surcharge. But just the possibility has spurred some lawmakers into action.

?It?s a waste of the legislative process,? said Mallory Duncan, senior vice president of the National Retail Federation. ?They could take steps to bring greater competition into the marketplace by prohibiting the price fixing of the hidden swipe fees merchants pay to process credit card transactions.?

Trish Wexler, spokesperson for the Electronic Payments Coalition, whose members include Visa and MasterCard Worldwide, told NBC News it has not taken a position on the issue.

?No one knows how checkout fees will work their way through the system,? Wexler said in an email statement, ?but the settlement provides sufficient consumer protections while the process plays out.?

What about disclosures?

The advocacy group Consumer Action has published a booklet on credit card checkout fees. It warns shoppers to be on the lookout for these fees and advises them to express their dissatisfaction.

?Customers shouldn?t stand for it,? said Ruth Susswein Consumer Action?s deputy director of national priorities. ?Our advice is to tell them you don?t like the fee and this makes you want to take your business elsewhere.?

The new rules from Visa and MasterCard require retailers who apply a credit card surcharge to post a notice at the store?s entrance. The exact percentage of the surcharge does not need to be disclosed until the point of sale. The customer receipt must list the amount of the surcharge.

Online stores with a surcharge will not be required to have a notice on the home page. They only need to alert shoppers about this when they reach the page where credit cards are first mentioned. In most cases, that means the final step of checkout when the purchase is being completed.

Not the end of this story

The settlement that allows merchants to impose a credit card surcharge is only preliminary. The court has yet to issue its final ruling in this case. That?s expected later this year.

Once that happens, various retailers and business groups plan to challenge the settlement. That could drag into late 2014.

The possibility that the settlement could be modified will probably keep most businesses of any size from instituting credit card fees for the time being.

Chinese Government Hacking Report used as Bait in new Cyber Attack

A high-profile report into a sophisticated and organised group of Chinese hackers linked to the Chinese government is being used as bait in a new targeted cyber-crime attack.

Earlier this week security experts Mandiant?published a report which revealed a sophisticed?Chinese hacker group, embedded deep within the Communist Party of China and linked to its military wing, had been infiltrating a huge number of organisations around the globe stealing masses of sensitive data.

The report, APT1: Exposing One of Chin's Cyber?Espionage Units, details Mandiat's work in tracking the group for the past seven years and monitoring their attacks on 141 organisation around the globe, with the vast majority based in the US.

However, just days after the report was published, it has been discovered that other cyber-criminals are using its publication as bait in an attempt to infect the computers of those who might be interested in reading it.

Security firm Symantec?has discovered emails?being circulated which have a fake copy of the report attached to them. While the sample Symantec?has come across are written in Japanese, there could easily be other emails in other languages spreading across the internet.

The email arrives with an attachment called Mandiat.pdf?which, when opened, displays a blank PDF document. In the background however, a piece of exploit code taking advantage of vulnerabilities in Adobe Reader and Adobe Acrobat is silently executed.

Symantec?has identified a number of pieces of malware?which the fake PDF document may drop onto your PC if the vulnerability is successfully exploited.

While the email purports to come from someone in the media, like in many targeted attacks, it is actually sent from a free email account and the content of the email uses subpar?language. "It is obvious to a typical Japanese person reading the email that it was not written by a native speaker," Joji?Hmaada?said on Symantec's?blog.

This is not the first time this tactic has been used. Back in 2011, when Symantec?released a whitepaper?on another group performing targeted attacks, the attackers took the opportunity to use the publication to infect those interested in reading the paper. They did this by spamming targets with the actual whitepaper?along with malware?hidden in an archive attachment.

What this shows is that cyber-criminals are no longer sticking to the same old ruses in order to trick people into downloading malware. They are using up-to-the-minute news and reports in order to trick targets into downloading what appears to be relevant and important documents.

Targeted attacks are much harder for traditional anti-virus security solutions to defend against, as they use a combination of social engineering and subterfuge to pypass?whatever security measures are in place.

Mandiant

The Mandiant?report in particular is of huge interest to the security world at the moment, detailing how sophisticated and well-funded cyber-crime has been used to gain access to some highly sensitive data from some of the world's biggest companies.

The group, dubbed Active Persistent Threat 1 (APT1) by Mandiant, is "one of the most prolific cyber?espionage groups in terms of the sheer quantity of information stolen" and it has stolen "hundreds of terabytes of data" over the past seven years.

With a very high degree of certainty, Mandiant?was able to link APT1 to the People's Liberation Army's (PLA's) Unit 61398 which is based in a non-descript 12-storey white building in the Pudong?New Area of Shanghai.

Mandiant's?report has forced the issue into public view and in response US President Barack Obama this week has singled out China and Russia as "aggressive" players in the cyber-espionage world, warning they will continue to try and steal US industrial and technological secrets.

In a report outlining plans to deal with the theft of American trade secrets, published in the wake of Mandiant's?report, the US government said:

"We judge that the governments of China and Russia will remain aggressive and capable collectors of sensitive US economic information and technologies, particularly in cyberspace."

Denial

China continues to deny being involved in cyber-espionage or cyber-theft with the Chinese defence minister calling the Mandiant?report deeply flawed. And he is not the only one, as security expert Jeffrey Carr says?the report has "critical analytic flaws" because Mandiant?"refuses to acknowledge that other nation states engage in cyber?espionage."

Carr goes on to suggest some critical analysis which could be carried out on the report to verify its findings, adding:

"My problem with this report is not that I don't believe that China engages in massive amounts of cyber?espionage. I know that they do. My problem is that Mandiant?refuses to consider what everyone that I know in the Intelligence Community acknowledges - that there are multiple states engaging in this activity; not just China."

A 1-2 knockout: McIlroy, Woods lose in Match Play

MARANA, Ariz. (AP) ? Rory McIlroy and Tiger Woods knocked out in the first round of the Match Play Championship? Not many would have given that a snowball's chance in the desert.

Almost as surprising as the freakish snowstorm on Dove Mountain was the sight of golf's two biggest stars heading to the airport, only the second time in the 15-year history of this wild tournament that No. 1 and No. 2 didn't last more than a day.

Shane Lowry of Ireland chipped in twice and drilled a fairway metal to 3 feet to seize control, and then knocked out McIlroy with a bunker shot to 4 feet to save par on the final hole. Just as the shock was wearing off, Charles Howell III came up with kind of shots he's used to seeing Woods make in the clutch ? a wedge that stopped inches from the cup on the 15th hole, and a 25-foot birdie on the 16th that carried him to a 2-and-1 victory.

"It's definitely a day I'm going to remember," said Lowry, the third player in the last four years to eliminate the No. 1 seed in the opening round.

"I had nothing to lose," Howell said.

The biggest loser Thursday might have been NBC Sports, which lost the two biggest draws.

Not even Phil Mickelson can save the day. He's not playing this year.

Howell had not faced Woods in match play since he was 17 and lost to him in the third round of the 1996 U.S. Amateur. He said he had never beaten him even in the dozens of casual games they played over the years at Isleworth before Woods moved away to south Florida.

What a time to change that losing streak.

Howell, who qualified for this World Golf Championship for the first time in five years, played a fabulous round in cold conditions. They matched scores 10 times in 14 holes before Howell came through with back-to-back birdies.

"In this format, match play is crazy," Howell said. "He's Tiger Woods. I was lucky to hang in there."

The final matches were played in near darkness, and they could have stopped after 15 holes. Woods wanted to play on, even though Howell had the momentum. Woods was 2 under for the day, and neither of them made a bogey.

"We both played well," Woods said. "He made a couple of more birdies than I did. He played well, and he's advancing."

McIlroy, the No. 1 player in the world, built a 2-up lead early in the match until Lowry rallied and grabbed the momentum by chipping in for birdie on the par-5 11th to avoid falling behind, chipping in from behind the 12th green for birdie and then ripping a fairway metal to within a few feet for a conceded eagle on the 13th to go 2 up.

Lowry missed a short par putt on the 14th, only for McIlroy to give away the next hole with a tee shot into the desert and a bunker shot that flew over the 15th green and into a cactus. But the two-time major champion hung tough, coming up with a clutch birdie on the 16th to stay in the game.

McIlroy nearly holed his bunker on the 18th, and Lowry followed with a steady shot out to 4 feet and calmly sank the putt.

"Deep down, I knew I could beat him," Lowry said. "There's a reason I'm here, and this is match play."

For McIlroy, more questions are sure to follow him to Florida for his road to the Masters. He now has played only 54 holes in the first two months of the season, missing the cut in Abu Dhabi and losing in the first round at Dove Mountain.

"You want to try and get as far as you can, but I guess that's match play," McIlroy said. "I probably would have lost by more if I had played someone else in the field. It wasn't a great quality match. But it would have been nice to get through and just get another day here and another competitive round under my belt."

The only other time the top two seeds lost in the opening round was in 2002, when Woods and Phil Mickelson lost at La Costa.

Luke Donald nearly made it the top three seeds except for a clutch performance. He holed a 10-foot birdie putt to halve the 17th hole and stay tied with Marcel Siem of Germany. Donald then birdied the 18th from 7 feet to win the match.

Louis Oosthuizen, the No. 4 seed, rallied to get past Richie Ramsay of Scotland.

The opening round was halted Wednesday after 3? hours because of a freak snowstorm that covered Dove Mountain with nearly 2 inches. It continued to snow at times overnight, and it took nearly five hours to clear snow from the golf course for the tournament to resume.

Turns out, snow wasn't the only surprise.

"I had to play extremely well to have a chance, and I still kept waiting for that Tiger moment," Howell said.

It never came.

Woods missed short birdie chances at the 10th and 11th, but the real damage came on the 15th when he went long of the green with a wedge in hand. Howell also missed a pair of short putts on the back nine, but he came up big with the putt on the 16th.

"Really, I didn't even realize I was 2 up with two to go until I got right to the tee on 17, and it actually threw me for a bit because I never maybe was really in the moment and didn't quite realize how things were," Howell said. "And as far as beating Tiger Woods, it shows you that match play is crazy. I did have to play a good round. But yeah, it's a bit hard to believe I'm sitting here today."

Howell and Lowry will have to wait until Friday to find out their opponents.

Carl Pettersson was 1 up on Rickie Fowler through 17 holes when they stopped because of darkness. The winner gets Lowry, who will be fighting some history. Of the previous three players to beat the No. 1 seed in the opening round, all of them lost in the second round.

Howell gets either Gonzalo Fernandez-Castano or Francesco Molinari, who were all square through 15 holes.

In other matches:

? Ernie Els lost in the opening round for the sixth time. He missed a 3-foot par putt on the 16th hole that would have given him the lead, and he missed a 5-foot par putt on the 18th hole to lose to Fredrik Jacobson.

? Russell Henley, two months into his rookie season, defeated the hottest player in the field when he took down Charl Schwartzel, who had won twice and finished no worse than fifth in his last six tournaments worldwide.

? Rafael Cabrera Bello beat Lee Westwood in 19 holes after Westwood missed a 6-foot par putt on the last hole.

The opening round of the Match Play is typically the best day in golf. This one took two days, and it was unlike any other.

Nearly 2 inches of snow covered Dove Mountain on Wednesday, and with more snow overnight, nothing had changed when players began arriving Thursday morning. There already was a two-hour delay when they arrived.

"There was a guy building a snowman this morning at 8, and they said they were going off at 10:30," Henley said. "I figured it was going to be awhile"

No one had an easier day than Bo Van Pelt.

Having won six straight holes to go 5 up before snow suspended play on Wednesday, Van Pelt finally got back on the golf course and struck all of two shots ? an 8-iron and a 45-foot putt. He won the 13th hole with a par to complete a 6-and-5 win over John Senden of Australia.

And then there was Sergio Garcia. He was one putt away from winning when play stopped Wednesday. He three-putted from 12 feet to lose the hole, and on the 18th hole, Thongchai Jaidee made a 6-foot birdie to send the match into overtime.

On the first extra hole, Garcia removed his cap and was putting his golf ball and tees in the bag as Jaidee settled over a 10-foot birdie. The putt ran around the back edge of the cup, giving Garcia life. He made birdie on the par-5 second hole to win in 20 holes.

So instead of hitting one shot Thursday, he had to play 19 of them. Garcia's was the first match of the tournament. It took him about 30 hours to finish.

"It's weirdness, I guess," Garcia said. "I guess at the end of the day, I was pleased to get through."

That's one thing McIlroy and Woods can't say.

CACI International Inc.'s decision to replace its CEO after less than two years on the job is part of a plan to refocus on new contract opportunities and acquistions of companies that can spur growth, Chairman Jack London and new CEO Kenneth Asbury told investors in a call Thursday morning.

Departing CEO Dan Allen didn't fit into that strategy, London said.

"What we're doing now is a bit of a modification to the strategy in the sense of priorities," he said. "The board determined that the best course of action is to put in place an aggressive business development ? a contract winning process ? under the direct leadership of an extremely qualified individual at the CEO level."

Whether the Arlington-based company's decision to replace Allen will be deemed a hasty one by investors, partners and government customers is yet to be determined.

Asbury, who was directly involved in efforts to capture contracts at Bethesda-based Lockheed Martin Corp., said he will reorganize the company to have business development operations report directly to his office.

"I would like to be personally involved in every one of the major bids we see in front of us," he said. "We intend to be a winner of those."

Personnel hires for the business development group will be addressed in the near term, Asbury noted.

The company wants to continue the aggressive acquisition strategy that was initiated 20 years ago and has led to nearly 60 buys thus far. Asbury pointed to cybersecurity as a key area for acquisitions, particularly in light of recent efforts by the Obama administration to better protect computer systems and trade secrets. Another possible target will be companies trying to exit certain services.

Here are some tips on how you can implement a low-fat, weight-loss diet and be successful:

1. Make a realistic plan

As noted above, a plan is essential if you want to stick with your diet and reach your goals. Just a vague ?I really shouldn?t be eating that? notion won?t cut it. It also won?t work if you are too strict with yourself right off the bat.

Trying to cut out all fat everywhere in every food is not realistic. So, set realistic goals and make a plan accordingly.

Here are some things to keep in mind when you make your plan:

* Some fat is okay, maybe even essential, for your health. Cutting out all fat is probably not a good idea health-wise or goal-wise.

* Decide on exceptions ahead of time. Don?t wait until the slice of fudge cake is in front of you before deciding if you are going to go ahead and make an exception and splurge. You might decide, for example, that you only eat cake at birthday celebrations and only eat hot dogs on Memorial Day. Reasonable exceptions are understandable and help make your diet doable.

* Remind yourself that your low-fat diet is pretty much permanent. The notion of going on a diet and then off of a diet may result in your weight going up and down. Adopt these low-fat goals as a lifestyle.

2. Gather recipes

Sometimes, making new foods that you don?t associate with high fat content and flavor can really help. Collect a series of low-fat recipes that can become family favorites.

This also gives you somewhere to turn when you need to think of a low-fat meal quickly. It can be easy to revert to the old, high-fat recipes when you are in a hurry or just frustrated with trying to lighten up existing ones.

Ford Fusion Energi Approved for California HOV Lane Access

The California Air Resources Board (CARB) has approved the Ford Fusion Energi plug-in hybrid for its carpool lane access program, helping the American automaker join Toyota at the top of the list with the most 2013 vehicles qualified for the HOV lane decal.

It is the ninth vehicle from Ford to qualify for carpool lane access through CARB since 1993; the Focus Electric and C-MAX Energi plug-in hybrid were also recently approved. Ford Fusion Energi buyers are also eligible to receive a $1,500 tax rebate along with a $3,750 federal tax credit.

The Fusion Energi has an EPA-estimated fuel economy of 100 MPGe combined with a total range of 620 miles on a single tank of gas and one full charge. The Fusion Energi has an electric-only range of up to 21 miles and has a top electric-only speed of 85 mph.

Tech Leaders Create Most Lucrative Science Prize In History

These massive awards go to researchers who have made truly novel discoveries. They tend to be older researchers past their prime who have already reaped rewards of their research (fame and likely money).

Funding for general research in life sciences has dipped to an all time low, with success rates less than 10% (it was much higher before the economic crisis a few years ago). The top amazing research by big groups still gets funded, but there is still some excellent work that goes unfunded, particularly by young up and coming talented researchers. These young investigators don't yet have a name for themselves, and unfortunately that impedes their ability to get grants and thus do their research.

The Gates foundation is an excellent example of how this can be done -- In today's economy, I would prefer to see something similar than a massive pot going to a few amazing but well established researchers. Of course this wouldn't have made the news if it wasn't over the top...

Shia LaBeouf and Alec Baldwin "Incompatible"? Actor tweets about exit From "Orphans"

LOS ANGELES (TheWrap.com) - Shia LaBeouf is taking a cue from his former co-star Alec Baldwin and using Twitter to defend his actions - in this case his split from "Orphans" on Broadway.

The show, which begins previews in less than a month, was to be the "Transformers" star's Great White Way debut. In a brief statement Wednesday, the actor's departure was attributed to those pesky "creative differences."

But LaBeouf, whose propensity to over-share has gotten him in trouble in the past, took to Twitter within hours of the announcement to post private emails from the show's director Daniel Sullivan and co-stars Baldwin and Tom Sturridge.

He also mused about the role of theater in society and posted his audition video for the show (he's twitchy, intense and, it must be said, pretty convincing as a criminal with a short fuse).

The correspondence does little to clarify the reasons for his abrupt exit, though his exchange with Sullivan hints at chemistry issues with Baldwin.

"I'm too old for disagreeable situations," Sullivan writes. "You're one hell of a great actor. Alec is who he is. You are who you are. You two are incompatible. I should have known it. This one will haunt me. You tried to warn me. You said you were a different breed. I didn't get it."

But an individual close to the production told TheWrap that the split had nothing to do with Baldwin; it was due to conflicts between the star and the show's producers, Frederick Zollo and Robert Cole.

Spokespeople for the production did not respond to requests for comment.

In his emails, LaBeouf also demonstrates a flair for the dramatic that New York theater critics will be denied an opportunity to see in the flesh.

"My dad was a drug dealer," LaBeouf writes. "He was a shit human. But he was a man. He taught me how to be a man. What I know of men Alec is."

"A man owns up," he adds. "That's why Mark McGuire is not a man."

If the message from Baldwin is to be believed, LaBeouf's former cast-mate wishes him well.

After LaBeouf apologizes for creating a "disagreeable situation," Baldwin assures him he doesn't have an "unkind word to say about you."

"I've been through this before," Baldwin writes. "It's been a while. And perhaps some of the particulars are different. But it comes down to the fact that what we all do now is critical. Perhaps especially for you. When the change comes, how do we handle it, whether it be good or bad? What do we learn?"

A spokesman for Baldwin declined to comment and a spokeswoman for LaBeouf did not respond to requests for comment.

Sturridge also is complimentary in his note to LaBeouf.

"I was stunned by the work you were doing, the performance you were giving," he writes."I think you lifted the play to a place higher than maybe it even deserved to be."

This is not the first time that LaBeouf has gotten in trouble for running his mouth off in public. In the past he irritated Steven Spielberg by speaking ill of their collaboration on "Indiana Jones and the Kingdom of the Crystal Skull"; said Oliver Stone played too nice when they teamed up on "Wall Street 2: Money Never Sleeps," and once revealed that he hooked up with "Transformers" co-star Megan Fox when she was on a break from her husband Brian Austin Green.

His frank talk and propensity to criticize former collaborators has inspired at least one high-profile rebuke.

Harrison Ford told Details Magazine that he was displeased by his co-stars comments about the Indiana Jones sequel.

"I think I told him he was a f---ing idiot," Ford said. "As an actor, I think it's my obligation to support the film without making a complete ass of myself."

On Wednesday and Thursday, LaBeouf also took the opportunity to share some colorful thoughts about acting, as well as some historical lessons of questionable veracity.

"Actors used to be buried with a stake through the heart," he tweeted. "Those peoples performances so troubled on-lookers that they feared their ghosts."

Oh, and based on his messages with Rick Sordelet, the show's fight director and a faculty member at Yale University's drama school, an MFA may be in LaBeouf's future...possibly one from a certain New Haven-based institute of higher learning.

In a message, Sordelet hails LaBeouf's work ethic and says he has been in touch with the head of the school's acting program about having him matriculate.

"It must have been difficult for others in the room to be schooled by someone who's raw talent and enthusiasm out matched theirs," Sordelet writes.

Sounds like somebody might be passing James Franco on the quad some day soon.
