WCA and Wayne State University celebrate the 100 year anniversary of Michigan?s first workers compensation law.
Most people have heard of workers compensation but don?t fully understand what is pays or its intended purpose. Workers compensation is a type of insurance that most employers are required to purchase by law. It is a compromise of employer and employee interests.
Michigan adopted its first workers compensation statute in 1912.? Employees gave up the right to sue their employers? in exchange for automatic but limited?benefits.
Employers pay the cost of this insurance and it is intended to protect both parties in the event of a work-related injury. It does not matter how an injury occurred or who was at fault.
Lost wages, medical treatment, and vocational rehabilitation are the primary benefits. Pain and suffering is not allowed.
100 Year Anniversary
The anniversary will be commemorated at an event hosted by Wayne State University Law School on October 18-19. The event is being facilitated in partnership with the Wayne State University History Department, the Wayne State University Law School, and is funded by the Workers Compensation Section of the Michigan State Bar. Governor Rick Snyder is also issuing a certificate of recognition for the 100th anniversary. Michigan?s workers compensation system is often recognized as a competitive asset for the state.
The Next 100 Years
Michigan?s workers compensation system is truly at a crossroads. Amendments to the Act in 2011? have made it impossible for some individuals to collect benefits. The great compromise is near its breaking point.
People with pre-existing degenerative conditions are now required to meet an impossible burden. If a person cannot show a pathological change, they have no remedy under workers compensation. Just because a person has some arthritis does not mean their injury?is any less legitimate.
This insurance company loophole must be closed. In the alternative, the Act should be amended to allow a person to assert their common law remedies in tort.
